Interpretations & Definitions.

For the purpose of these terms and conditions the „photographer“ or „artist“ shall mean Lisa Vieten trading as VIETEN EQUINE IMAGES. VIETEN EQUINE IMAGES will be referred to as the „company“, „we“, „us“ or „our“. www.vietenequineimages.com will be referred to as the „website" and you as the client or purchaser will be referred to as the „client“ or „purchaser“ and any person who accesses the website purchaser or not will be referred to as „you“. By booking with or purchasing from VIETEN EQUINE IMAGE you agree to the below terms & conditions

By using the website you agree to be bound by the terms of this legal agreement between you and VIETEN EQUINE IMAGES which sets out the terms and conditions relating to the use of the service provided via the website which also may contain links to other third party sites. you acknowledge and agree that a) the company has no control over third party sites which you link to through the site or via links to the site; b) we are not responsible for the availability of such third party sites; c) we do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such third party sites; and d) we are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party sites.

The company makes all reasonable efforts to ensure the accuracy of the information contained within the website, however the company accepts no liability for any inaccuracies or mistakes that may arise and the purchaser will have no claim against the company in respect of these or their effect. The company will correct any inaccuracies should they arise as soon as this is brought to its attention. Please direct any corrections or observations to contact us. The company reserves the right to cancel or decline any order from any person or business in any jurisdiction.

The purchaser or any person accessing the website will acknowledge that all information, imagery, copyrights, designs, products, propriety information rights and any other information displayed on the website is solely the property of the company and belong to and be the absolute property of us automatically and without further formality on their coming into existence.

Products - Prints & Photo Shoots.

Prints - General.

The products contained within the website may differ slightly in colour from the way they are represented from one computer monitor to another. What you may see on screen represents the colour you should expect to receive but can only be used as a guide not an exact representation. The purchased fine art prints must not be scanned or duplicated. The client is aware that colour dyes in photography may fade or discolour over time due to the inherent qualities of dyes, and the client releases VIETEN EQUINE IMAGES from any liability for any claims whatsoever based upon fading or discolouration due to such inherent qualities. VIETEN EQUINE IMAGES will make every effort to provide the most accurate colour reproduction on products purchased through VIETEN EQUINE IMAGES. The company has no liability whatsoever toward the quality of any prints or products reproduced by the client from digital files purchased from or provided by the company. It is recommended when displaying or storing prints, to use archival materials whenever possible.

Prints - Pricing.

All prices are displayed on the website and are inclusive of local taxes. All prices are quoted in pounds’ sterling. In the event a typographical or human error in relation to prices and sizes the company has the right to cancel orders and can accept no liability whatsoever.

Prints - Payment.

Payment of goods can be transacted by credit/debit card via Paypal or direct Bank Transfer (BACS).

Prints - Delivery.

Once payment has been received by way of cleared funds purchasers should allow up to 12 working days for delivery within the UK, for delivery to continental Europe up to 17 working days, for delivery to the rest of the world approx. 21 working days. Items will be dispatched by the company's preferred distribution partners. If in the unlikely event the product arrives damaged the purchaser must notify the company within 2 days of receipt of the product so the company can adhere to its insurance policy with its preferred delivery partners.

Photo Shoot - General.

The client assumes all responsibility for their horse(s) or any other subjects during the session, including injury or damage caused to horse, rider, property or any individual before, during or after the photo shoot. Know your horse(s) and their behavior and limitations before bringing them to any public area. It is your responsibility to tell the photographer if you feel that the location or situation put your horse in danger. If your horse tends to kick, bite or may shows other misbehaviour you also are required to mention it to the photographer to keep everybody safe. If you choose, at your own discretion, to ride your horse without a riding hat, you do so entirely at your own risk. The photographer has the right to stop the session if they are concerned about the horse’s welfare, safety or behaviour during the session (no refunds provided).

Photo Shoot - Photographs.

If you upload your images on the web (Social Media) you will be required to only use the small resolution digital images (JPEG) with the photographer's logo. You are not permitted to remove the logo or edit the images (changing colours, or removing part of the image). The high resolution digital images (JPEG) without logo are for print use only. You cannot enter any of your images in competition (online or otherwise). The client is responsible to keep digitals safe and to make duplicates. Any request for additional digital image duplicates from the photographer will incur additional charges. Digital files are provided as JPEG only, edited in the photographer's style. The fine art prints you receive as part of the photo shoot package must not be scanned or duplicated.

Photo Shoot - Pricing.

All prices are displayed on the website and are excluding shipping costs. All prices are quoted in pounds’ sterling. In the event a typographical or human error in relation to prices and content of the photo shoot packages the company has the right to cancel bookings and can accept no liability whatsoever.

Photo Shoot - Delivery procedure.

Within 1-2 weeks (depending on order situation) after the shooting you will receive an online gallery (via email) with your pre-edited & watermarked photos. After receiving the email you have a 2 week time frame for transmitting your decision regarding your desired photographs. In case you select more images than including your chosen photo shoot package (e.g. if an additional horse attended the session or you simply wish for additional images) you will receive an invoice for the outstanding amount (to be paid within a 1 week time frame). No part of any order will be delivered until the required balance is paid in full. All such payments are final and are not refundable. It will take 2-8 weeks until your very personal art is with you. Your fine art prints will be dispatched in a solid cardboard package and your digital files delivered via download link by mail.

Photo Shoot - Postponement.

If VIETEN EQUINE IMAGES has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid and a new, mutually agreed appointment will be made with no additional charge. In the event of any situation out of our control (corona virus, storm, fire, etc.) we will postpone the sessions and reschedule once our doors reopen.

Photo Shoot - Travel costs.

Our fees include travelling expenses up to 25 miles from the WA7 4ES postcode. Locations further away are charged at £0,40 per mile after the first 25 miles. The photographer may require accommodation where the photography location is at a distance of 90 miles or greater from the WA7 4ES postcode. The cost of accommodation and expenses shall be covered by the client.

Copyrights.

All website design, text, graphic and designs of the prints and or products within the website are under strict copyright © VIETEN EQUINE IMAGES. You may not modify or replicate any item in any way without permission. You are not permitted to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in this website.

By using this website, purchasing our products you agree to abide by the terms and conditions set out in it.

VIETEN EQUINE IMAGES reserves the right to amend these terms and conditions without prior notice.
